Terms and conditions
These terms apply to everyone who registers, bids or buys in the Temwa Summer 2026 Art Auction. Please read them before you bid — placing a bid means you accept them.
Who you are dealing with
Temwa is the seller. Temwa is a registered charity in England and Wales (no. 1185889), and every lot in this auction has been donated to Temwa by the artist. The contract of sale is between Temwa and the winning bidder.
The auction is conducted and hosted by Kevin Durham, The Charity Auctioneer. He provides the auction website and calls the live sale. He is not the seller, does not own the artwork, and does not hold your money — payments are made directly to Temwa through their own payment provider.
When the auction runs
- Pre-bidding opened on Thursday 30 July 2026 and stays open until the live auction begins.
- The live online auction begins at 7pm on Monday 10 August 2026.
- The auction ends when the auctioneer has sold the final lot.
There is no countdown clock. Unlike most online auctions, lots do not close at a set time. During the live auction the auctioneer closes each lot himself when bidding on it is finished, exactly as he would bring down a hammer in a room. Once he closes a lot, the highest bid at that moment wins and no further bids can be placed on it.
Registering and bidding
- You need an account to bid. Please give accurate contact details — they are how we tell you if you have been outbid and how we reach you if you win.
- You must add a payment card before you can bid. This is how payment is taken if you win.
- When you bid, a £1 authorisation is placed on your card to confirm it is valid. This is not a payment. Your bank may show it as pending and it disappears by itself. Nothing further is charged unless you win.
- You are responsible for bids placed from your account. Please keep your password to yourself.
- Bids are binding and cannot be withdrawn once placed.
- The highest bid when the auctioneer closes a lot wins that lot.
How bidding on your behalf works. When you place a bid, you are telling us the most you are willing to pay. The system then bids for you, one step at a time, and only as high as it needs to go to keep you in front. If nobody outbids you, you win at the lower figure — not at your maximum. Bidding rises in set steps based on what a lot is worth, and the next step is always shown on the lot.
Temwa and the auctioneer may refuse or cancel any bid, withdraw any lot before it is sold, reopen a lot if something has plainly gone wrong, and correct any obvious error in a listing. On the night, the auctioneer’s decision on the conduct of the sale is final.
The artwork
- Temwa has made every effort to describe and photograph each lot accurately. Descriptions and images are provided by Temwa and the donating artists.
- Each listing states whether a work is framed or unframed.
- Estimated values are a guide to what a piece might be expected to fetch. They are not valuations, appraisals or guarantees, and are not a promise of resale value.
- All artwork is sold as seen.
If you win
- You will be emailed as soon as the lot closes, and in any case within one day of the auction ending.
- Your saved card is charged automatically for the winning amount. There is normally nothing further for you to do.
- If that payment cannot be taken — for example your card has expired or is declined — we will email you a payment link. Payment must then be made in full within 7 days.
- If payment has not been made within those 7 days, the winning bid may be forfeited and the lot offered to the next highest bidder.
- Payment is by debit or credit card, taken securely by Stripe. Your full card details are never held by Temwa or by the auctioneer.
Getting your artwork
- Temwa will deliver to winning bidders living in Bristol.
- If you live outside Bristol you can either collect from Temwa’s central Bristol office, or pay the cost of postage or courier.
- Risk in the artwork passes to you when it is collected by you, delivered to you, or handed to a courier you have arranged.
Liability
- Temwa is not liable for errors or omissions in the auction process, or for any damage or loss to artwork after it has been collected by the winning bidder or their courier.
- Neither Temwa nor the auctioneer is liable for any technical fault, interruption, delay or loss of connection affecting the auction website, or for any bid that fails to reach us as a result.
- The auction website is provided as it stands. We cannot guarantee it will be uninterrupted or error-free.
Nothing in these terms takes away rights you have by law. Some kinds of liability cannot be excluded, and we are not attempting to.
Your information
Temwa is responsible for how your information is used and holds it in line with Temwa’s privacy notice. The auction website is operated on Temwa’s behalf by The Charity Auctioneer, who handles your information only to run the auction. Card details are handled by Stripe and are not stored by Temwa or the auctioneer.
General
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If any part of these terms turns out to be unenforceable, the rest continues to apply.
